Welcome to Positivity Ping — a premium lifestyle-only listening and unwind service. By booking, purchasing, or participating in any session (“Session”), you agree to the following Terms & Conditions (“Terms”). Please read them carefully before engaging with our service.
1. Nature of the Service
Positivity Ping provides lifestyle-focused conversation and companion experiences designed to help clients relax, reflect, and unwind in a safe and professional environment. Sessions may take place online or in person.
- This is not a dating or escort service.
- This is not therapy or medical care. No representative is a licensed therapist, psychologist, or medical professional.
- Sessions are strictly for lifestyle enrichment and personal reflection.
- Unless otherwise stated for a specific corporate engagement, all sessions are conducted in English only.
2. Eligibility
Clients must be 18 years or older and legally capable of entering into binding agreements. By booking, you confirm that all information you provide is accurate and that you will engage respectfully with the assigned listener or companion.
3. Session Formats
Sessions are available in the following formats:
- Call Sessions — Conducted by phone or approved calling app at the scheduled time.
- Online Video Sessions — Conducted via Google Meet, Zoom, WhatsApp Video, or FaceTime.
- In-Person Café Sessions — Held at Positivity Ping–approved cafés or public venues in Warsaw (individual clients only).
- Walk & Talk Sessions — Conducted at pre-approved safe walking routes within our service area.
4. Connection & Technical Issues
- If a video session cannot proceed due to lost internet connection, both parties will attempt to reconnect within 10 minutes.
- If reconnection fails, the remaining time may be rescheduled at no extra cost.
- If the client fails to answer two call attempts within the first 10 minutes, the session will be marked as a no-show and the fee forfeited.
- Persistent issues caused by the client’s setup (weak signal, device issues) may result in forfeiture of the session fee.
5. Payments
Payment terms differ for individual/concierge bookings and for corporate clients:
- Individual and Concierge Bookings: All sessions must be prepaid in full at the time of booking through our secure online platform. Sessions are not confirmed until payment has been received.
- Corporate Clients: Corporate sessions, retainers, or wellbeing programs are invoiced to the company. Payment is due within 30 calendar days from the invoice date unless otherwise specified in the agreement.
- VAT: Prices are quoted net of VAT; +23% VAT applies where required by law. For eligible cross-border EU B2B supplies with a valid VAT ID, reverse-charge rules may apply; non-EU exports may be zero-rated per applicable regulations.
- Late corporate payments may incur statutory interest charges in accordance with applicable Polish law.
- All rates are quoted in PLN unless otherwise agreed. International corporate clients may be billed in USD or EUR.
- Optional add-ons (e.g., formal NDAs, premium venues, travel expenses) are invoiced separately and may require prepayment.
6. Confidentiality & Optional NDA
All sessions are covered by our standard confidentiality policy. Clients seeking added discretion may request an optional Non-Disclosure Agreement (NDA) prior to the session.
- The NDA applies to both client and listener.
- A small administrative fee covers document preparation and secure storage.
- We handle all personal data in compliance with GDPR and our Privacy Policy.
- No recording: We do not record sessions. Clients may not record without prior written consent.
7. Client Behaviour & Respect Policy
Positivity Ping is committed to maintaining a safe, respectful, and comfortable space for both clients and listeners.
- All interactions must remain respectful, calm, and non-violent.
- Any form of sexual, suggestive, aggressive, or discriminatory behavior is strictly prohibited.
- The listener reserves the right to immediately end a session if they feel unsafe, disrespected, or uncomfortable — without refund.
- Clients must not record, photograph, or share session content without explicit written permission.
- Repeat or serious violations may result in permanent suspension from all Positivity Ping services.
8. Cancellations & Refunds (Individuals)
- Cancellations made more than 24 hours before a session are fully refundable.
- Cancellations within 24 hours may be charged up to 100% of the fee.
- No-shows (missed calls or arrivals) are non-refundable.
- If Positivity Ping cancels due to unforeseen circumstances, clients may reschedule or receive a full refund.
- No refunds are issued for sessions ended due to disrespectful, unsafe, or inappropriate client behaviour.
9. Safety for In-Person Sessions
- All in-person meetings occur at public or pre-approved safe venues for individuals, or at client offices/studio for corporate engagements.
- The listener’s safety is of paramount importance. If a session location or interaction feels unsafe, the listener may leave immediately without refund.
- Clients are responsible for their personal belongings and behaviour during sessions.
10. Corporate Terms (Overview)
Corporate listening services are tailored for organisations seeking to support staff wellbeing through private, confidential sessions.
- Access is provided via a private Corporate Booking Hub and a Booking Alias (a non-indexed link or address unique to the company) for scheduling.
- Corporate packages are sold in hour-packs (e.g., 10h) and are drawn in 15-minute increments.
- Validity: Standard corporate packs are valid for 30 days from activation; Executive Access packs are valid for 60 days.
- Language: Unless expressly agreed, all sessions are delivered in English only.
- Locations: Online (secure video), our Warsaw studio, or at the client’s office within Warsaw city limits (Zone A). Neutral private rooms are available only under the Executive Access addendum. Addresses outside Zone A are by proposal and may involve travel/setup fees.
- Corporate liaison: The company appoints a single point of contact for coordination, billing, and compliance (NDA/DPA/MSA).
11. Corporate Booking, Cancellations & Rescheduling Policy
- How to book: Employees book via the Corporate Booking Hub using the company’s Booking Alias. The alias must not contain personal names or sensitive identifiers and should not be publicly shared.
- Standard sessions (online or studio): Free cancellation/reschedule with ≥24h notice. <24h is charged in full (booked time deducted from the pack).
- Onsite sessions (client office) or neutral-venue sessions: Free cancellation/reschedule with ≥48h notice. <48h: booked time deducted and any third-party fees (e.g., venue) are passed through at cost.
- No-shows & late start: If the participant is more than 10 minutes late or does not attend, the booked time is deducted in full.
- Same-day changes: Not guaranteed. Executive Access may permit limited same-day slots (see Section 14).
- Pack expiry: Unused hours expire at the end of the validity period; extensions require written agreement prior to expiry.
12. Confidentiality & Reporting (Corporate)
We protect employee privacy and provide value to organisations through aggregate insights only.
- No session content is captured, stored, or reported. We do not keep session transcripts or notes.
- Anonymised reports may include: total hours used/remaining, unique participant counts, format mix (online/studio/onsite), booking trends, and anonymous satisfaction averages.
- Reporting threshold: To protect anonymity, no report line is produced for groups with fewer than 5 unique participants in a period.
- No individual tracking: HR/Management will not receive names, attendance records, or any personal identifiers.
- Security: Reports exclude free-text fields and are delivered to the corporate liaison only.
13. Data Protection (GDPR)
We handle personal data in accordance with GDPR.
- Roles: For booking/contact/billing data we generally act as an independent controller. Where a signed DPA specifies processor terms (e.g., certain integrations), we will act as processor for that scope.
- Data minimisation: We avoid collecting special-category data. We do not keep session notes.
- Storage & locality: Primary systems are hosted in the EEA. If a sub-processor outside the EEA is necessary, appropriate safeguards (e.g., SCCs) are used.
- Retention: Booking metadata and invoices are retained for legal/accounting requirements (typically up to 6 years). Prospect communications are retained up to 12 months from last contact, unless otherwise agreed.
- Rights: Data subjects may exercise access, rectification, erasure, restriction, and objection rights by contacting support@positivityping.com. Additional terms may apply under a signed DPA.
- DPA/MSA/NDA: Available upon request; administrative review fees may apply depending on scope.
14. Executive Access (C-Suite) Addendum
- Named-Executive Continuity: The same listener is assigned for continuity. If unavailable (illness/emergency), we will offer: (a) a qualified substitute, or (b) a validity extension suitable to the delay.
- Extended Hours: 07:00–21:00 (Mon–Fri), with limited Saturday availability on request.
- Same-Day Access: Up to 2 same-day slots per 10h pack (subject to availability).
- Booking Alias + NDA/DPA: Executive engagements include a private booking alias and, on request, an NDA/DPA. Company-paper NDAs or security questionnaires may incur a one-time onboarding fee.
- Neutral Venue Credit: Optional, up to 600 PLN per 10h pack for a vetted private room (not cafés/open spaces). We book from our shortlist; overage is re-billed at cost. 24–48h notice required. Unused credit expires with the pack. Limit: up to 2 neutral-venue bookings per pack.
- Validity: Executive packs are valid for 60 days from activation, drawn in 15-minute increments.
15. Concierge Terms
Concierge Listening provides bespoke, on-location sessions for private clients within Warsaw or abroad, by special arrangement.
- Concierge sessions involve travel to the client’s chosen venue and must be requested and confirmed in advance.
- Safety and respect are essential. The listener may refuse or end the session immediately if the environment or conduct is unsafe, inappropriate, or disrespectful.
- No refunds will be provided in such cases.
- Travel and accommodation costs (if applicable) are billed separately and must be prepaid.
- Clients are responsible for providing a quiet, safe, and private space suitable for conversation.
- Positivity Ping may decline requests that fall outside professional or ethical boundaries.
16. Limitation of Liability
Participation is voluntary and at your own discretion. Positivity Ping and its representatives are not liable for any indirect, incidental, or consequential damages resulting from the service. We make no guarantees about emotional outcomes or perceived benefits.
17. Intellectual Property
All content, branding, and materials of Positivity Ping are owned by us or our licensors. You may not reproduce, distribute, or adapt any part without prior written consent.
18. Indemnification
You agree to indemnify and hold harmless Positivity Ping, its owners, and affiliates from any claims or damages arising out of your use of the Service or violation of these Terms.
19. Amendments
We may update these Terms periodically. The latest version will always be posted on this page. Continued use of the Service constitutes acceptance of the updated Terms.
20. Governing Law
These Terms are governed by the laws of Poland. Any disputes will be handled in the competent courts of Warsaw, unless otherwise required by law.
